Tax Equity and Fiscal Responsibility Act (TEFRA)

The Tax Equity and Fiscal Responsibility Act (TEFRA) of 1982 is designed to make Medicare the secondary payer for certain employees and spouses over age 65. Under the TEFRA law and subsequent legislation, the group is the primary payer and Medicare is the secondary payer of claims for working-aged employees and certain dependents in employer groups with 20 or more full-time and/or part-time employees.

We will send a Medicare Secondary Payer (MSP) Reply Form to you on an annual basis to update our records relative to your payroll information. It is important to remember that we will process claims according to the information you provide. You are legally responsible for reporting your group’s information correctly. If you refuse to report or fraudulently report your data, you may be subject to serious financial consequences, which may include a fine and an IRS imposed excise tax.
